Welcome to GalleryBridge. These Terms & Conditions govern your use of the GalleryBridge platform, whether as an artist, shop owner, or customer. By using our services, you agree to these terms.

1. Artist Terms

  • Ownership Rights: Artists retain full ownership rights to their artwork
  • Representation: Artists are responsible for accurately representing their work, including dimensions, materials, and condition
  • Pricing & Fees: Artists set their own prices and agree to pay platform fees for successful sales
  • Rights Verification: Artists must ensure they have the right to sell the artwork they list
  • Fulfillment: Artists are responsible for fulfilling orders and shipping artwork to customers

2. Shop Owner Terms

  • Display Conditions: Shop owners must maintain appropriate display conditions for artwork
  • QR Code Display: Shop owners agree to display QR codes prominently with artwork
  • Sales Process: Shop owners cannot sell artwork directly; all sales must go through the GalleryBridge platform
  • Commissions: Shop owners receive an agreed-upon commission for sales of artwork displayed in their space
  • Reporting: Shop owners must report any damage or issues with displayed artwork promptly

3. Customer Terms

  • Direct Purchase: Customers purchase artwork directly from artists through our platform
  • Payments: All payments are processed securely through our payment provider
  • Shipping: Shipping terms and delivery times are set by individual artists
  • Returns: Return policies are subject to individual artist terms

4. Platform Fees & Payments

  • Platform Fees: GalleryBridge charges a platform fee on successful sales
  • Shop Commissions: Shop owners receive their commission automatically through the platform
  • Artist Payments: Artists receive payments after deduction of platform fees and shop commissions
  • Payment Security: All payments are processed securely through our payment provider

5. Intellectual Property

  • Artist Rights: Artists retain all intellectual property rights to their work
  • Platform Rights: The GalleryBridge platform and its content are protected by copyright and other intellectual property rights
  • Display Materials: QR codes and display materials remain the property of Gallery Bridge

6. Dispute Resolution

Any disputes between artists, shop owners, or customers will be handled through our dispute resolution process. All parties agree to attempt resolution through our platform before pursuing other legal remedies.

7. Modifications to Terms

GalleryBridge reserves the right to modify these terms at any time. Users will be notified of significant changes, and continued use of the platform constitutes acceptance of modified terms.

8. Data Retention

We retain different types of data for specific periods to maintain service quality while respecting privacy:

  • Transaction Records: Maintained for 7 years to comply with financial regulations and tax requirements
  • Artwork Information: Kept for the duration of listing plus 2 years after removal for dispute resolution
  • QR Code Analytics: Engagement data retained for 12 months for performance analysis
  • Account Information: Maintained while account is active; deleted 30 days after account closure
  • Shop Display History: Retained for 3 years to track artwork placement and commission records
  • Communication Records: Kept for 2 years to handle disputes and maintain service quality
